1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the MyTaskMaster platform operated by My Task Master Ltd ("we", "us", "our", "MyTaskMaster").

By accessing or using our platform at mytaskmaster.io or any associated mobile applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our platform.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use constitutes acceptance of modified Terms.

2. Definitions

  • "Platform": The MyTaskMaster website, mobile applications, and all associated services
  • "Customer": An individual or business seeking home services through our platform
  • "Trade Professional" or "Tradesperson": A verified service provider offering services through our platform
  • "Service Request": A customer's request for quotes or services from tradespeople
  • "Lead": Customer contact information and service request details provided to trade professionals
  • "Subscription": A recurring payment plan for trade professionals to access platform features

3. Platform Description

MyTaskMaster is an online marketplace connecting customers with trade professionals for home services including (but not limited to) plumbing, electrical work, cleaning, gardening, pest control, and other home improvement services.

3.1 Our Role

Important: MyTaskMaster is an intermediary platform. We:

  • Facilitate connections between customers and trade professionals
  • Provide communication tools and platform infrastructure
  • Verify trade professional credentials to the extent reasonably practicable
  • Do NOT perform the actual services
  • Do NOT employ or control trade professionals (they are independent contractors)
  • Do NOT guarantee the quality, safety, or legality of services provided

All service contracts are directly between customers and trade professionals. MyTaskMaster is not a party to these contracts and bears no liability for services performed.

4. Eligibility and Account Registration

4.1 Age Requirements

You must be at least 18 years old to use our platform. By registering, you confirm you meet this requirement.

4.2 Account Registration

To use certain features, you must create an account by providing:

  • Accurate, complete, and current information
  • A valid email address and phone number
  • Secure password (you are responsible for maintaining its confidentiality)

4.3 Account Security

You are responsible for:

  • All activities under your account
  • Maintaining the security of your login credentials
  • Notifying us immediately of unauthorized access

4.4 Prohibited Users

You may not use the platform if you:

  • Have been previously banned or suspended
  • Are located in a jurisdiction where our services are prohibited
  • Intend to use the platform for illegal purposes

5. Terms for Customers

5.1 Service Requests

When submitting a service request, you agree to:

  • Provide accurate and complete information about the required service
  • Respond promptly to tradesperson inquiries
  • Allow matched trade professionals to contact you via phone, SMS, WhatsApp, or email
  • Not submit false, misleading, or fraudulent requests

5.2 No Fees for Customers

Using the platform to submit service requests is free for customers. You pay tradespeople directly for services rendered, not MyTaskMaster. We do not charge customers for receiving quotes or using the platform.

5.3 Engaging Trade Professionals

When hiring a tradesperson, you agree to:

  • Communicate terms, pricing, and expectations clearly
  • Pay agreed fees directly to the tradesperson (not through MyTaskMaster unless specified)
  • Treat trade professionals with respect and professionalism
  • Allow reasonable access to property for work completion
  • Notify us of any serious issues or disputes

5.4 Customer Responsibilities

  • Verify tradesperson credentials and insurance independently
  • Obtain written quotes and contracts before work begins
  • Inspect completed work and address concerns promptly
  • Comply with all applicable laws and regulations

6. Terms for Trade Professionals

6.1 Registration Requirements

To register as a trade professional, you must:

  • Provide valid business registration or sole trader details
  • Hold appropriate licenses, certifications, and qualifications for your trade
  • Maintain valid public liability insurance (minimum £5,000,000 coverage recommended)
  • Provide proof of identity and address
  • Pass background checks where applicable
  • Agree to comply with all relevant health and safety regulations

6.2 Lead Fees

Trade professionals pay for leads (customer contact information and service requests) through our platform.

  • Lead Pricing: Leads are priced between £15 and £40 depending on service type, job value, and location
  • Payment: Lead fees are charged immediately upon lead purchase
  • No Refunds: Lead fees are generally non-refundable, except in cases of proven fraud or significant platform error
  • Lead Quality: We strive to provide genuine leads but cannot guarantee conversion or customer engagement

6.3 Subscription Plans

Trade professionals can subscribe to monthly plans for enhanced platform access:

  • Pricing: Subscription fees range from £99 to £499 per month
  • Benefits: Plans may include priority lead access, reduced lead fees, enhanced profiles, analytics, and support
  • Billing: Subscriptions renew automatically on the billing date
  • Cancellation: You may cancel at any time; cancellation takes effect at the end of the current billing period
  • No Pro-Rata Refunds: Subscription fees are not refunded upon early cancellation

6.4 Professional Obligations

As a trade professional, you agree to:

  • Respond to leads promptly (within 24 hours recommended)
  • Provide accurate, competitive quotes
  • Perform services professionally and to industry standards
  • Comply with all relevant laws, regulations, and building codes
  • Maintain valid insurance throughout service provision
  • Respect customer property and privacy
  • Resolve disputes professionally and in good faith
  • Not engage in fraudulent, misleading, or deceptive practices

6.5 Independent Contractor Status

You acknowledge and agree that you are an independent contractor, not an employee, agent, or partner of MyTaskMaster. You are responsible for:

  • Your own taxes, National Insurance contributions, and VAT (if applicable)
  • Your own insurance, equipment, and tools
  • Compliance with employment laws if you have employees
  • All aspects of service delivery and customer contracts

6.6 Prohibited Conduct

Trade professionals must NOT:

  • Contact customers outside the platform before purchasing a lead
  • Share leads with other tradespeople without customer consent
  • Submit false reviews or manipulate ratings
  • Harass, abuse, or discriminate against customers
  • Use the platform for illegal activities
  • Circumvent platform fees by directing customers to off-platform payments for initial leads

7. Payment Terms

7.1 Payment Processing

All payments to MyTaskMaster (lead fees, subscriptions) are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service.

7.2 Payment Methods

We accept:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Bank transfers (for subscription plans)

7.3 Failed Payments

If a payment fails (e.g., expired card, insufficient funds), we may:

  • Suspend your access to leads and platform features
  • Retry payment automatically
  • Terminate your account if payment issues persist

7.4 Refund Policy

Lead Fees: Generally non-refundable. Refunds may be issued at our sole discretion in cases of:

  • Fraudulent or duplicate leads
  • Leads with incorrect or false contact information
  • Platform errors that prevent lead access

Refund requests must be submitted within 7 days of purchase with supporting evidence.

Subscriptions: Non-refundable. Cancellations take effect at the end of the billing period.

7.5 Price Changes

We reserve the right to modify lead fees and subscription prices. Changes will be communicated with at least 14 days' notice. Continued use constitutes acceptance of new pricing.

7.6 VAT

All prices are exclusive of VAT unless stated otherwise. VAT will be added at the applicable rate where required by law.

8. Prohibited Conduct

All users must NOT:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Scrape, harvest, or collect user data without permission
  • Impersonate others or create false identities
  • Engage in fraudulent, abusive, or harassing behavior
  • Post offensive, discriminatory, or inappropriate content
  • Interfere with platform functionality or other users' access
  • Use automated systems (bots) without our written permission
  • Reverse engineer or attempt to extract source code

9. Intellectual Property Rights

9.1 Our IP

All content, features, and functionality on our platform (including but not limited to text, graphics, logos, icons, images, software, algorithms) are owned by My Task Master Ltd and protected by UK and international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for its intended purpose. You may not reproduce, distribute, modify, or create derivative works without our written permission.

9.3 User Content

By submitting content to our platform (reviews, photos, messages), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for platform operation, marketing, and improvement purposes.

You retain ownership of your content but warrant that you have the right to grant this license and that your content does not infringe third-party rights.

10. Disclaimers and Limitation of Liability

10.1 Platform "As Is"

Our platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantees

We do not guarantee:

  • Uninterrupted or error-free platform operation
  • Accuracy, reliability, or completeness of content
  • Quality, safety, or legality of services provided by trade professionals
  • Accuracy of user-provided information
  • That trade professionals will respond to service requests
  • That customers will hire trade professionals

10.3 Limitation of Liability

To the maximum extent permitted by law, My Task Master Ltd, its directors, employees, and affiliates shall NOT be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage arising from services performed by trade professionals
  • Disputes between customers and trade professionals
  • Actions or omissions of platform users
  • Unauthorized access to or alteration of your data
  • Third-party content, products, or services accessed through our platform

Maximum Liability: Our total liability for any claim arising from your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

10.4 Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under UK law

11. Indemnification

You agree to indemnify, defend, and hold harmless My Task Master Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Services provided or received through the platform
  • Your content or conduct on the platform

12. Termination and Suspension

12.1 Termination by You

You may terminate your account at any time by contacting support@mytaskmaster.io or using the account deletion feature. Outstanding payments remain due upon termination.

12.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

  • You breach these Terms
  • You engage in fraudulent, illegal, or harmful conduct
  • Your payment methods fail repeatedly
  • You receive multiple customer complaints or negative reviews
  • We are required to do so by law or legal authority
  • We cease platform operations

12.3 Effect of Termination

Upon termination:

  • Your access to the platform will be revoked immediately
  • We may delete your account and data (subject to legal retention requirements)
  • You remain liable for outstanding payments
  • Provisions regarding liability, indemnification, and intellectual property survive termination

13. Dispute Resolution

13.1 Customer-Tradesperson Disputes

Disputes between customers and trade professionals regarding services, payments, or quality are not our responsibility. Parties should resolve disputes directly and professionally. We may, at our discretion, provide mediation or guidance but are not obligated to do so.

13.2 Platform Disputes

For disputes with MyTaskMaster, please contact us first at support@mytaskmaster.io. We will attempt to resolve issues informally within 30 days.

13.3 Governing Law

These Terms are governed by the laws of England and Wales. Any legal proceedings must be brought in the courts of England and Wales.

14. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data in compliance with UK GDPR.

15. Communications and Notices

By using the platform, you consent to receive communications from us via:

  • Email (to your registered email address)
  • SMS and WhatsApp (to your registered phone number)
  • In-platform notifications

Communications may include service updates, lead notifications, payment confirmations, and marketing messages (you can opt out of marketing communications).

Official notices to us should be sent to: legal@mytaskmaster.io or by post to our registered address.

16. Miscellaneous Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Task Master Ltd regarding platform use.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control (natural disasters, strikes, internet outages, government actions, etc.).

16.6 Third-Party Rights

These Terms do not confer rights on any third parties under the Contracts (Rights of Third Parties) Act 1999.

18. Acknowledgment

By using our platform, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms and Conditions
  • You have reviewed our Privacy Policy
  • You understand MyTaskMaster is an intermediary platform, not a service provider
  • You accept the risks associated with engaging trade professionals or customers through our platform
  • You are responsible for verifying credentials, insurance, and qualifications independently
  • All service contracts are between customers and trade professionals, not with MyTaskMaster

If you do not agree to these Terms, you must immediately cease using the platform.
